These Website Terms and Conditions of Use ("Terms of Service" or "Terms and Conditions") govern the rights, obligations, and provisions applicable to any person accessing and/or using the Mario Minardi website ("Website"), including viewing product information, placing orders, making transactions, or using other features available on the Website.

1. DEFINITIONS

· MMI: PT Mario Minardi Indonesia as the manager and/or party providing products and services through the Website.

· Product: Goods displayed and/or offered through the Website, including but not limited to footwear products and other products available from time to time.
· Order: A request to purchase Products made by the User through the Website.
· Transaction: The activity of purchasing Products conducted by the User through the Website and/or other methods provided by MMI.
2. ACCEPTANCE AND AGREEMENT
· By accessing or using the Website, the User represents that they have read and agreed to these Terms and Conditions.
· The User is required to use the Website responsibly and in accordance with applicable laws and regulations in the Republic of Indonesia.
· MMI reserves the right to amend, add to, or update these Terms and Conditions from time to time.
· Amendments to the Terms and Conditions shall become effective as of the date they are published on the Website, unless determined otherwise by MMI.
3. USE OF THE WEBSITE
· Users are only permitted to use the Website for lawful purposes and in accordance with the functionality of the Website.
· Users are prohibited from:
a. Using the Website for unlawful purposes;
b. Engaging in any action that may disrupt, damage, overburden, or impair the operation of the Website;
c. Obtaining or attempting to obtain unauthorized access to systems, servers, accounts, or parts of the Website not intended for the User;
d. Using software, automated systems, bots, scrapers, or other methods to extract, copy, or collect data from the Website without prior written consent from MMI;

· MMI reserves the right to restrict, suspend, or terminate User access to the Website if there is suspected violation of these Terms and Conditions or applicable laws.
4. PRODUCT INFORMATION AND CUSTOM ORDERS
· General Product Information Terms
a. MMI strives to provide accurate, complete, and up-to-date Product information, including product names, descriptions, sizing, colors, materials, photos, and other details.
b. There may be slight variations between the Product color displayed on the User's device screen and the actual color depending on screen display settings.
c. Photos, illustrations, dimensions, specifications, and Product information on the Website are subject to change from time to time without prior notice.
d. Product availability is subject to change at any time. The display of a Product on the Website does not guarantee its availability at the time of ordering.
e. In the event of material errors in Product information, MMI reserves the right to make corrections and notify the User before or after an order is placed.
· Custom Orders Terms (Bespoke / Made-to-Order / MTO)
a. Production Timeline: Made-to-Order (MTO) or Bespoke orders require estimated lead times that will be communicated to the Customer upon placing the order.
b. Non-Cancellable & Non-Refundable: Custom orders that have entered processing or production cannot be cancelled, modified, or returned, unless there is a genuine manufacturing defect attributable to Us.
c. Sizing & Fitting: Customers are responsible for providing accurate measurements or attending scheduled fitting sessions. Post-production alterations may incur additional charges depending on customization complexity.
5. PRODUCT PRICING
· Product prices listed on the Website are expressed in Indonesian Rupiah (IDR), unless stated otherwise.
· Prices are subject to change at any time at MMI's discretion.
· The price applicable to an Order is the price listed at the time the Order is placed, except in cases of obvious technical or typographical pricing errors.
· Shipping fees, service fees, taxes, or other applicable charges may apply to the User and will be detailed during the checkout process.
6. ORDERING
· Users may place Product orders through the ordering mechanisms provided on the Website.
· Users must provide truthful, complete, and accurate information when placing an order, including full name, shipping address, contact phone number, email address, and other required information.
· Users are fully responsible for all information submitted during the ordering process.
· Submitted Orders shall not be considered accepted by MMI until MMI issues a formal confirmation according to standard Website procedures.
· MMI reserves the right to decline or cancel Orders under certain conditions, including but not limited to:
a. Product unavailability;
b. Pricing or product information errors;
c. System failures or technical errors;
d. Indications of unauthorized or suspicious transactions;
e. Incomplete or unverifiable User information; or
f. Other legitimate and justifiable reasons.
· If an Order is cancelled after payment has been completed, refunds will be issued in accordance with MMI's refund policy and the payment method used, subject to applicable regulations.
7. PAYMENT
· Payments must be made through the payment methods made available by MMI on the Website.
· Users must ensure that all payment details provided are accurate and valid.
· MMI is not liable for payment failures caused by third-party payment gateway providers, financial institutions, network interruptions, or other external causes beyond MMI's reasonable control.
· MMI reserves the right to verify payments and transactions prior to processing Orders.
8. SHIPPING AND DELIVERY
· Products will be shipped to the delivery address provided by the User at the time of ordering.
· Estimated delivery timelines may vary depending on destination location, shipping method, Product availability, and logistics provider operational conditions.
· Delivery delays caused by courier services, severe weather, natural disasters, transportation disruptions, government policies, or other events beyond MMI's control shall not be deemed negligence on MMI's part.
· Users are responsible for ensuring that the delivery address and contact information provided are accurate and accessible.
9. CANCELLATION, RETURNS, AND REFUNDS
· Terms governing Order cancellations, Product returns, exchanges, and/or refunds are subject to MMI's policies in effect at the time of the transaction.
· Requests for returns or exchanges must meet MMI's eligibility requirements, including submission deadlines and product condition criteria.
· Returned Products may be rejected if they show signs of wear/use, damage caused by User error, or failure to satisfy MMI's return conditions.
· If a received Product is damaged or mismatched due to MMI's responsibility, the User may contact MMI Customer Service through the contact channels on the Website.
· Approved refunds will be processed according to the timeline and procedures set by MMI and/or the respective payment gateway providers.
10. INTELLECTUAL PROPERTY RIGHTS

· MMI will make reasonable commercial efforts to resume service fulfillment once the force majeure event subsides.
